Trial underway for man who refused to show ID to TSA agents

opening statements kicked off this afternoon in the trial of a seattle man who made national headlines in albuquerque.. phil mocek is facing several charges after refusing to show t-s-a officers his i-d at the sunport-- and then videotaping his altercation with officers. our kayla anderson is live at the metro courthouse with the latest. the first witness we heard from today is the tsa officer who confronted phil mocek. he says mocek shouldn't have been filming, because there was nsitive documents in the camera's view. but mocek continued to argue that it was his right to film in a public place... eventually arguing until police arrested him. phil mocek is in an albuquerque courtroom-- the center of a national debate. he was arrested in late 2009 -- after he refused to show his identification to t-s-a officers at the sunport checkpoint. police say he was disruptive and caused a scene. "mr. mocek began to protest. he began to take out his camera and start to film what was going on." mocek is charged with "disorderly conduct" - "refusing to obey an officer" - "criminal trespassing" - and "concealing his identity." "after you evaluate all of the evidence, you will come to the conclusion that mr. mocek is guilty of all four of these charges." the defense argues mocek was cooperative during the entire incident... adding there was nothing illegal about him using his cell phone to record the incident, even though he was told to stop taping. "he never concealed his identity. he had a boarding pass in his own name, phillip mocek and he had no other identification in his luggage. so he wasn't concealing anything from anyone." supporters from across the country were also in the courtroom today... saying mocek's arrest trampled on his first amendment rights. "mr. mocek did nothing illegal that day. the only thing that happened that day was that the tsa and the officers were the ones out of control, were the ones making the commotion and were the ones shouting." the prosecution is expected to wrap its case today-- after jurors hear from an aviation officer. then the defense starts its list of witnesses tomorrow. reporting live from metro court, kayla anderson, kob eyewitness news 4.
