new at six: police are searching for a murder suspect after jail officials in mckinney county mistakenly set him free. gadi schwartz is live in santa fe with a story you will see first on four. 22-year-old tobey gonzales is supposed to be locked up while he awaits trial for murder. police say he minute thumbnail 06:03 pm helped tie up - beat and burn steven duran to death in an arroyo about a mile away from ojo caliente last year. so you can imagine the horror for the victim's mother- when she started getting calls that her son's accused killer toby gonzales was spotted walking the streets of espanola this weekend- mckinley county jail officials confirm gonzales' mom picked him up at the jail saturday. jail officials say they are looking into why he was released. one supervisor i spoke to on the phone this afternoon said he was unaware gonzales was charged with murder. gonzales was being held in tierra amarilla for duran's murder -- but was transferred to the mckinley county detention center to prevent him from being housed in the same jail as the other suspect in the case. santa fe's district attorney spence pacheco is very upset over the release of a murder suspect and is looking into how this happened. a bench warrant for an unauthorized release from jail has been issued and police are now looking for gonzales.
