charges will be dismissed for the time being against former district court judge pat murdoch....who's accused of raping a prostitute. new at ten... we're hearing from murdoch's lawyer about this latest development. joe vigil is live with what this all means. joe. the charges will be dismissed---with the option of them being refiled at a later date which isn't unusual. but pat murdoch's attorney is hoping the charges will never be refiled. today santa fe county d-a angela pacheco said rape and intimidation of a witness charges against former judge murdoch would be dismissed, for now. she was named special prosecutor in the case against... because of a conflict of interest with the d-a in bernalillo county where murdoch worked. "my reaction is a positive one. i applaud mrs. pacheco and the idea that there is no need to rush to judgement in this matter." murdoch's lawyer amahd assed says he thinks albuquerque police rushed to judgement "and" doesn't like how police treated his client. assed says when murdoch was arrested at district court in albuquerque police tried to cuff him even though he uses crutches to walk because of his polio. we are also hearing from apd that new charges could be filed after a search of murdoch's computer and phone records. investigators say the suspected prostitute videotaped an encounter with murdoch at his home and told investigators she saw child porn on his computer. we asked assed if he knew anything about new charges. "no i don't. i know as much as you do." while assed won't go into specifics of the case he's hoping his client will be vindicated. "hopefully on a throughout look at the entirety of the case they will agree that this is not a case that should proceed to prosecution. and hopefull they will not refile charges." in dismissing the charges--for now--the special prosecutor may want more time to investigate. those charges are expected to formally dismissed tomorrow
