the mother accused of suffocating her son, reviving him and suffocating him again is in minute thumbnail 12:01 pm court right no her defense team is requesting several things today-- including to move the case out of bernalillo county. cristina rodda just stepped out of the courtroom. she's live at district court with the details. cristina? two motions filed -- are very important. as you mentioned -- one would get the case moved out of bernalillo county. the second request is to not allow what tiffany toribio told police when they tracked her down... to be used during the trial. here is toribio in court today. the judge heard from witnesses about how police tracked her down in may 2009 -- and connected her to the three year-old boy found buried in the playground at alvarado park. toribio told police she suffocated tyrus, revived him then suffocated him again. she said she didn't want him to grow up like her -- without anyone caring about him. minute thumbnail 12:02 pm some of toribio's family was in court-- many were asked to leave because they are witnesses in the trial-- including her sister. 07:003 -- :12 "i feel like i'm split right down the middle i understand where they are coming from if i'm a witness and i'm not going to say anything i already told them." the defense wants the statement toribio made to police dismissed because they say it came as a result of a warrantless arrest without probable cause. on the stand the detectives who tracked toribio down say they clearly identified themselves... they say -- they were told toribio spent her days riding up and down central on the city buses. that's where they finally found her in downtown -- 5 days after her son's body was discovered buried at the park. when i left the courtroom the judge had not made a decision on that motion, or any others. be sure to watch kob eyewitness news four throughout the day for the very latest. live from district court cristina rodda kob eyewitness news four. new at noon..
